Patrick M. Bailey is a Florida attorney focusing on litigation and appeals. Patrick represents companies and their owners in shareholder and LLC member disputes, and in business and construction litigation.

Patrick served as a clerk to Justice Jorge Labarga of the Florida Supreme Court and at the Fourth District Court of Appeal. In private practice, he has worked at both the trial level and the appellate level, in both state and federal court.

Patrick leverages his experience to think several steps ahead in litigation. He brings both a bird’s-eye view and an attention to detail that allows him to see the inflection points in a case and leverage them to his clients’ advantage.

Representative Matters

Appellate

  • Obtained reversal of a premature attorney’s fee award against homeowners in an association dispute. Rigoli v. Preserve at Bay Hill Estates Homeowners Ass’n, Inc., 432 So. 3d 525 (Fla. 4th DCA 2026).
  • Obtained affirmance of final order dismissing claim alleging faulty self-driving software. Stucky v. BMW of North America, LLC, No. 4D2023-1596 (Fla. 4th DCA 2024).

Trial

  • Represented several condominium and homeowners associations in foreclosure and enforcement proceedings against unit owners.
  • Represented general contractor in a dispute against municipality and subcontractors for breach of contract, breach of duty of care, and other claims, resulting in favorable settlement.
  • Successfully shielded chief executive officer of major corporation from deposition under the apex doctrine.
